Voluntary Participation: I, the undersigned participant, hereby affirm my intention to voluntarily engage in the activities, workshops, and sessions (hereinafter referred to as “Activities”) offered by Hopein Ashaeiyn Pvt Ltd (Also known as “Ashaeiynn”- Third Eye Opening Meditation Centre). I understand that my participation is a voluntary act, and I have the freedom to withdraw from any activity at any time without prejudice to my future participation in Ashaeiynn’s programs. My decision to participate is made with full acknowledgment of my free will and a comprehensive understanding of the nature of the Activities.
Nature and Purpose of Activities: I recognize that the Activities offered by Ashaeiynn are designed to facilitate spiritual growth, mindfulness, and personal development. These Activities may include, but are not limited to, guided meditation, yoga, breathwork, spiritual counselling, and any other practices aimed at enhancing mental, emotional, and spiritual well-being. I understand that these Activities are intended for personal growth and are not a substitute for medical or psychological treatment.
Informed Consent and Understanding: I hereby confirm that Ashaeiynn has provided me with detailed information regarding the Activities, including their potential benefits and the inherent risks involved. This information has covered the physical, emotional, and psychological demands of the Activities and the potential impact they may have on participants. I acknowledge that, like any program of a spiritual or physical nature, there may be risks, including but not limited to emotional distress, physical injury, or other discomforts.
Understanding these risks, I nevertheless choose to participate in the Activities, agreeing to take full responsibility for my engagement and experience.
Acknowledgment of Personal Responsibility: I affirm that I am responsible for assessing the extent to which I can engage in the Activities given my physical, mental, and emotional condition. I acknowledge it is my responsibility to seek professional advice regarding my condition as necessary. I agree to inform Ashaeiynn’s staff or facilitators of any limitations or medical conditions that may affect my ability to participate fully in the Activities. Furthermore, I commit to respecting the boundaries and physical well-being of myself and others during the Activities.
Assumption of Risk: By signing this document, I expressly assume the risks associated with the Activities, including risks of physical injury, emotional distress, and mental discomfort. I understand that Ashaeiynn will take reasonable steps to provide a safe environment for the Activities but acknowledge that not all risks can be foreseen or mitigated. I hereby release Ashaeiynn, its staff, volunteers, and representatives from all liability for any harm, injury, or damage that may occur to me or my property arising from my voluntary participation in the Activities, to the fullest extent permitted by law.
Complete Understanding: I affirm that I have read this Consent and Acknowledgment section thoroughly, that I fully understand its terms, and that I am signing it freely and without any duress. I acknowledge that this Consent and Acknowledgment forms part of a broader agreement between myself and Ashaeiynn and that no oral representations, statements, or inducements apart from the written agreement have been made.
Legal Provisions and Releases
No Objection Certificate (NOC): I, the undersigned, voluntarily elect to participate in the activities and programs (collectively referred to as “Activities”) offered by Hopein Ashaeiyn Pvt Ltd-Third Eye Activation Meditation Centre and its affiliates (“Ashaeiynn”). By signing this document, I grant a No Objection Certificate (NOC) to Ashaeiynn, affirming that my decision to participate is made freely, without any form of undue pressure, coercion, or influence from Ashaeiynn or any related parties. I understand that this NOC serves as my express consent to participate and waives any claims against Ashaeiynn concerning my voluntary participation. This NOC does not waive Ashaeiynn’s responsibilities as outlined or any liabilities arising from their gross negligence or willful misconduct.
Comprehensive Release and Waiver of Liability: In acknowledgment of the benefits of participation and in consideration thereof, I hereby agree to release, waive, discharge, and covenant not to sue Ashaeiynn, its affiliates, trustees, officers, agents, employees, and volunteers from any and all claims, demands, lawsuits, rights, and causes of action of whatever kind or nature, arising from or by reason of any known or unknown, foreseen or unforeseen, bodily or mental injury, death, property damage, or consequences thereof, resulting from or related to my voluntary participation in the Activities, whether arising from the negligence of the released parties or otherwise, to the fullest extent permitted by law.
Health Declaration and Medical Release: I represent that my physical and mental health is adequate to engage safely in the Activities, and this status is affirmed by medical advice, personal assessment, or existing knowledge. I understand the importance of self-monitoring during the Activities and agree to withdraw from participation if any health risks become evident. Furthermore, I consent to receive first aid and medical treatment deemed necessary by Ashaeiynn in the event of an injury or emergency during my participation. I acknowledge that Ashaeiynn is not liable for the costs of any medical treatment I receive, and this consent does not impose a duty upon Ashaeiynn to provide such treatment.
Confidentiality and Privacy: I commit to uphold the confidentiality and privacy of all personal and sensitive information to which I may be privy during my participation in the Activities. This includes, but is not limited to, personal stories, practices, and experiences shared within the group setting. I understand that this commitment is crucial to maintaining a safe and respectful environment for all participants and facilitators. Breach of this confidentiality agreement may result in my immediate removal from the program without recourse.
Intellectual Property Acknowledgment: I acknowledge that all materials, teachings, practices, and intellectual property shared or disclosed during the Activities are the exclusive property of Ashaeiynn. These materials are provided for my personal use and development only and may not be copied, reproduced, distributed, taught, or utilised in any form or by any means outside the context of personal study without the prior written consent of Ashaeiynn. Unauthorised use of these materials may lead to legal action and prosecution to the fullest extent under applicable law.
Governing Law and Dispute Resolution: This agreement, and all aspects of the relationship between the parties, shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. Any disputes, controversies, or claims arising out of or relating to this agreement, including the breach, termination, enforcement, interpretation, or validity thereof, shall be first addressed through good faith negotiations and mediation. Should mediation fail to resolve the dispute, it shall then be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
